2009 Legislative Session

Below is the summary of the bills we are following.

 

HB 6 – Appropriations for MO Department of Natural Resources, which includes the funding for the soil and water conservation program.  Introduced 3-3-09 and referred to the Budget Committee.  Public Hearing held on 3-11-09 with the Budget Committee voting Do Pass on their committee substitute.  Their committee substitute did not change any of the amounts of funding for the soil and water program.    On 3-18-09 HB 6 was reported Do Pass to the House and referred to the Rules Committee.  The Rules Committee voted Do Pass with Time Limit on the committee substitute on 3-23-09.  The bill is currently on the Calendar of House Bills for Perfection with total debate limited 10 hours for HB 1 through HB 13.  Taken up for perfection on 3-24 and 3-25.  House amendments 1 through 8 were adopted. None of the amendments involved the soil and water program budget.  HB6 was passed with amendments on 3-26-09 on a vote of 119 to 32.  Reported to the Senate on 3-30 and referred to the Appropriations Committee on 3-31-09.  Public hearings held April 1 through April 8.  Senate Committee voted Do Pass on 4-8-09.  HB 6 was reported Do Pass to the Senate on 4-13-09 and the Senate Committee substitute was adopted by the Senate on 4-14-09 with a vote of 26-4.  It was reported back to the House on 4-14-09 and if the House does not concede to the Senate version, it will go to conference.  The Committee Substitutes and Amendments throughout this process have not affected the Soil and Water Program budget.   04/21/2009 Senate Conference Committee Appointed: SENATORS NODLER, MAYER, BRAY, GREEN AND RUPP.   04/27/2009 House Conference Committee Appointed: REPRESENTATIVES ICET, STREAM, SATER, KELLY AND CURLS.  Conference Committee hearing held on 4-29/30-09 with the Conference Committee voting Do Pass on 4-30-09.  HB Truly Agreed to and Finally Passed on 5-7-09.   HB 6

HB 67 -- Changes the laws regarding dam and reservoir safety.  Sponsor:  Walt Bivins.  Prefiled 12/01/08, Second Read on 01/08/09, and assigned to the Energy and Environment Committee on 2-19-09.  HB 67

HB 428 -- Defines the purpose of the state soil and water conservation cost-share program.  Proposed effective date 08/28/2009.  Sponsor:  Mike Sutherland.  Introduced01/28/2009.  The bill was assigned to the Conservation and Natural Resources Committee on 2-19-09.  Hearing held on 3-4-09.  The bill was voted Do Pass by the House Committee on 4-1-09 and will now be heading to the House floor for a vote before going to the Senate.    HB 428   HB428 was combined with SB 539 as part of a House Committee Substitute on 4-21-09.  This bill was voted Do Pass by the House Rural Community Development Committee on 4-23-09 sent to Fiscal Review and voted Do Pass by Fiscal Review on 5-7-09.  Since the bill has already been through the Senate originally, after approval by the full House, it will have to go back to the Senate for them to agree with the changes made by the House.  The House passed SB 539 on 5-13-09 with a vote of 144-9.  All amendments offered during House debate did not affect the soil and water part of the bill.  The bill was sent back to the Senate where they did not approve the amendments put in by the House and asked for a Conference Committee.  The Conference Committee was named on 5-14-09.  SB 539  Also on 5-13-09 the Senate added the language of HB428 to HB250 and voted approval of it by a vote of 32 to 1.  They also added an Emergency Clause which means the bill will become effective when signed by the Governor. This was approved by a vote of 33 to 1.  Then the bill went back to the house for their approval which they did on 5-14-09.  Now it is sent to the Governor for his signature.  The Governor has fifteen days to act on a bill if it is sent to him during the legislative session; and forty-five days if the legislature has adjourned.  HB250

Legislative Session ends on May 15, 2009.  Appropriations must be truly agreed to and finally passed by 6:00 p.m. on May 8, 2009.  Veto Session is September 16, 2009.
